Terms of Service

1. Who we are and what these terms cover

RealSite is operated by Longtek Pty Ltd (ABN 37 670 334 451) of 35 Market Street, South Melbourne VIC 3205 (we, us, our). These terms govern your access to and use of the RealSite website and web application (the Service).

By creating an account, starting a trial or using the Service you agree to these terms. If you use the Service for an organisation, you confirm you are authorised to bind it.

2. The Service

RealSite is a search and research tool for commercial property. It combines parcel, zoning, planning, sales, development application, traffic and listing data from third-party and public sources.

Coverage varies by state and by data layer, and is described on our pricing page. We may add, change or remove features and data sources. We will give reasonable notice of any change that materially reduces what your plan includes.

3. Accounts and security

You must provide accurate information, keep your credentials confidential and tell us promptly if you suspect unauthorised access. Plans are single-seat: you must not share your login with other people.

You are responsible for activity on your account.

4. Plans, free trial and payment

Paid plans are billed in Australian dollars, in advance, monthly or annually, through our payment processor (Stripe). Prices are shown excluding GST; GST is added where it applies, and we will issue a tax invoice.

Every plan starts with a free trial. A card is required to start the trial. Nothing is charged until the trial ends. If you do not cancel before the trial ends, your plan renews and your card is charged the price for the plan and billing interval you selected.

Your subscription renews automatically each billing period until cancelled. You can cancel at any time from Plan & billing. Cancellation takes effect at the end of the period you have paid for. Except where the Australian Consumer Law requires otherwise, fees already paid are not refundable.

Upgrades take effect immediately and are pro-rated. Downgrades apply from the next billing period. We may change prices on at least 30 days' written notice; the new price applies from your next renewal.

The live demo is a read-only account provided for evaluation. It may be changed or withdrawn at any time.

5. Acceptable use

The Service is for searching and researching sites, one person at a time. You must not, and must not help anyone else to:

• scrape, crawl, spider or harvest the Service or its data, including by paging through search results, map views or listings to collect them;
• bulk export, systematically download, copy or store the data beyond what the Service's own features (such as reports) produce for your use;
• resell, redistribute, sublicense or publish the data, or use it to build or enrich a competing product, database or dataset;
• access the Service by bots, scripts, headless browsers or any other automated means, except through an API we provide to you for that purpose and in line with its terms;
• share your login or account with anyone else, or let more than one person use a single-seat plan;
• attempt to bypass plan limits, fair-use limits, security or access controls, including by using multiple accounts, rotating IP addresses or repeatedly starting demo sessions, or probe the Service for vulnerabilities;
• use the Service, or contact details or ownership information obtained through it, in breach of the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth) or any other law; or
• resell or sublicense access to the Service without our written agreement.

Fair-use limits apply to every plan and to the live demo, including limits on the number of searches, results, listing and parcel views, map data and reports in a period. They are set to sit well above normal use, and we may change them. When you reach a limit, the Service will tell you; daily limits reset at midnight AEST. If your work needs more, contact info@realsite.com.au and we will consider raising it.

We monitor usage to enforce these terms. If we reasonably believe an account breaches this section, we may throttle, suspend or close it, with or without notice, and we are not required to refund fees for the period of suspension.

6. Data, reports and accuracy

Data in the Service is compiled from third-party and public sources and is provided as a research aid. It may be incomplete, out of date or contain errors. Zoning, overlays, land size, traffic counts, sales and application data must be verified against the primary source before you rely on it.

RealSite does not provide legal, planning, valuation, financial or investment advice. Reports generated by the Service are not a substitute for professional advice or a statutory certificate.

You may use reports for your own internal business purposes and to share with your clients, lenders, landlords or advisers in connection with a specific site. Third-party data remains subject to its owners' terms and licences.

7. Your content

You keep ownership of the filters, Projects, notes and other content you create in the Service. You grant us a limited licence to host and process that content to provide the Service to you.

8. Intellectual property

We and our licensors own the Service, its software, design, compiled datasets and trade marks. Subject to these terms and your active plan, we grant you a non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes.

9. Availability and support

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may carry out maintenance, which we will try to schedule outside business hours. Support is by email at info@realsite.com.au.

10. Warranties and liability

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term, that you have under the Australian Consumer Law or any other law that cannot be excluded.

Subject to that, and to the maximum extent permitted by law: the Service is provided as is; we exclude all other warranties; we are not liable for indirect or consequential loss, loss of profit, loss of opportunity or loss arising from a decision you make using the data; and our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim arose or, where the law allows, resupplying the Service.

11. Suspension and termination

You can stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these terms, if a payment fails and is not remedied, or if we are required to by law.

On termination your right to use the Service ends. Your account data is handled in line with our Privacy Policy, including deletion within 30 days of an account deletion request.

12. Privacy

Our handling of personal information is described in the Privacy Policy at /privacy, which forms part of these terms.

13. Changes to these terms

We may update these terms. For material changes we will notify you by email or in the Service at least 14 days before they take effect. Continued use after that date means you accept the updated terms. The version in force is shown at the top of this page.

14. Governing law and contact

These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
